Information
Although
it is not required by Ontario statute, as a
business matter it is considered prudent to
conduct a search against the proposed Sole
Proprietorship Name (prior to registration) to
determine if there are any identical or
confusingly similar names. Notwithstanding the
foregoing, you will not be precluded by the
Ontario Ministry of Government Services from
registering a Sole Proprietorship Name even if
there are other identical registered Ontario
business names; however, that is a practical
business decision for you to make as to
whether you still wish to proceed with the
registration of the Sole Proprietorship Name
or select an alternate name. Important:
Registration of a business name under the
Business Names Act (Ontario) does not protect
the business name or give the registrant any
rights to the business name that it does not
otherwise have. We strongly recommend that you
seek legal advice from a lawyer if you have
any questions or require any guidance
regarding the foregoing.
